DARKE COUNTY - Dustin M. Barton of Greenville was charged on Friday with inflicting physical harm while in the act of a theft offense, which is a felony of the second degree.


If found guilty of the charge, Barton could face up to eight years in prison and a maximum fine of $15,0000.


At approximately 2:10 a.m., a Greenville police officer responded to the area of Grant Street and East Fourth Street in reference to a 911 call to the Darke County Sheriff’s Office. The sheriff’s office advised they could hear subjects demanding money and then heard a scuffle, then the call was disconnected.


According to the case’s affidavit, the officer was advised by the victim that he was jumped by several suspects, including Barton.


The officer later observed Barton running in the area, initiated pursuit, and was able to tackle him to the ground and detain him, according to the affidavit. Barton then admitted to being with two other males while they assaulted the victim, taking their wallet and phone.


Barton was then arrested and transported to the Darke County Sheriff’s Office Jail.


Barton has a preliminary hearing scheduled for April 8 at 3:30 p.m.
