Fatal accident driver was over legal limit

XENIA — The driver in an August fatal accident was over the legal limit, according to the State Highway Patrol accident report.

According to the report, Kathy J. Smith, 62, of Xenia, had a .343, more than four times the legal limit of .08 when she hit head-on a pickup truck driven by Raymond Deyo, 68, of Bowersville. Deyo was pronounced dead at the scene, while his wife, Linda L. Deyo, 66, and Smith, were taken to area hospitals with what were then life-threatening injuries.

Smith was convicted of an OVI in 2013, according to Xenia Municipal Court records.

A civil suit has been filed on behalf Linda Deyo and Raymond Deyo’s estate asking for a “prayer amount in excess of” $25,000, according to Greene County Common Please Court records. The case was filed Oct. 19.

The Gazette staff is working to see if charges are forthcoming.
